Arbitration and Mediation Court (AMC)

The Arbitration and Mediation Court (AMC) was founded as a permanent arbitration institution on 17 January 2003, in compliance with the Law on Arbitration Nu.129-XIII of 31 May 1994. The main goal of the AMC is to organize and administer the resolution of disputes through out of court procedures, using alternative methods (arbitration, mediation and conciliation). The AMC carries out its activity based on Law No. 129-XIII, international conventions on arbitration matters, to which the Republic of Moldova is a party, Civil Procedure Code of the Republic of Moldova No. 225-XV of 30 May 2003, Regulations on the Organization and Operation of the Arbitration and Mediation Court, Rules of Arbitration, Rules of Mediation and Conciliation, Norms on Arbitration Fees and Expenses.

Mr. Ion Paduraru is the AMC chairman, and Mr. Dumitru Brasoveanu is its deputy chairman. According to the structural scheme, the AMC operates through its central secretariat office and regional secretariat offices, which makes arbitration and mediation accessible to potential beneficiaries throughout the entire republic.

The AMC was founded by following the experience of developed states, which has demonstrated that mediation and arbitration are traditional elements needed in a free market economy that is based on private property and contractual relations. Dispute resolution through alternative methods is a matter of honor for entrepreneurs who care about their image and good relations with their business partners. Arbitration and mediation have gained authority over the centuries due to the advantages offered to the parties involved in a dispute. The most relevant of these advantages include:

• Short period and a simplified procedure for dispute resolution (the maximum deadline for settling an arbitration procedure within the AMC is 6 months).
• The possibility to save money: arbitration fees used within the AMC are at least 4 times lower than the fees charged by state courts for the same disputes; in addition, certain categories of persons (pensioners, etc.) are exempted from arbitration/mediation fees.
• The possibility to choose arbitrators/mediators with a proper professional background and experience that is required for the efficient resolution of the case: the list of AMC arbitrators includes well-known specialists in law, economics, accounting, agribusiness, etc.
• The procedure is confidential, with the possibility to negotiate and determine the conditions for dispute resolution.

The AMC is authorized to solve internal and international disputes for which the law allows signing arbitration agreements, including:
• commercial disputes (purchase/sale, exchange, donation, service provision, intermediary services, etc.), including upon contract conclusion, execution or termination;
• disputes arising from the conclusion, execution or termination of agricultural land or property lease contracts;
• disputes regarding the use of property jointly privatized by groups of participants during the farm privatization process, as well as disputes regarding the division of such property;
• disputes deriving from other civil relations.

The AMC inauguration as a permanent arbitration institution was preceded by over three years experience in settling disputes through mediation and ad-hoc arbitration. The AMC practice includes more than 1000 civil disputes regarding the execution of ownership rights over agricultural land and property of former collective enterprises allocated into private ownership, as well as commercial disputes, including international ones.

The AMC carries out activities on promoting alternative dispute resolution methods in the civil society. The official AMC inauguration took place on 31 January 2003. Round table discussions were organized in the regional centers of the republic with the participation of representatives from state courts, local authorities, attorneys at law, entrepreneurs, etc. Training seminars and publications on dispute settlement through alternative methods are important components of the AMC activity.

The AMC actively cooperates with various national and international partner institutions. To date, the AMC is the host institution for students from the law faculty of the Moldovan State University who are taking internship courses in mediation and arbitration as part of a project implemented by the Legal Clinic of the Moldovan State University in cooperation with the AMC.
